By accessing or using any BW Property, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must discontinue use of all BW Properties immediately.

1. Intellectual Property Rights

All content produced, published, or distributed under Brickstone Works, Arcayd Entertainment, and Valver Technologies — including but not limited to game code, software, artwork, music, characters, storylines, application interfaces, website design, logos, and brand names — is the exclusive intellectual property of Brickstone Works and is protected under applicable copyright, trademark, and intellectual property law.

You are expressly prohibited from reproducing, distributing, modifying, reverse-engineering, decompiling, sublicensing, selling, or otherwise commercially exploiting any BW Property or any component thereof without prior explicit written authorisation from Brickstone Works.

Permitted non-commercial uses include:

• Sharing links to official BW web pages
• Creating non-commercial fan works clearly attributed as unofficial
• Discussing BW content for purposes of commentary, criticism, or review

2. Prohibited Conduct

When accessing or using any BW Property, you agree not to:

• Use cheats, hacks, exploits, or unauthorised third-party software in connection with any BW game or application
• Misrepresent yourself as being affiliated with, employed by, or acting on behalf of Brickstone Works, Arcayd Entertainment, or Valver Technologies
• Use any BW content, in whole or in part, to train, fine-tune, or otherwise develop artificial intelligence or machine learning models
• Claim ownership of any brand, project, game, application, or other work produced by Brickstone Works
• Redistribute, resell, or republish any BW software, game, or digital product in any form without written permission
• Engage in any activity that damages, disrupts, or places undue burden on BW websites or services

3. Disclaimer of Warranties

All BW Properties are provided on an “as is” and “as available” basis, without warranties of any kind, express or implied. Brickstone Works makes no representations or warranties regarding:

• The compatibility of any software or game with your specific hardware or operating system
• The uninterrupted, error-free, or secure operation of any BW Property
• The accuracy or completeness of any information presented on BW websites

Your use of any BW Property is entirely at your own risk.

4. Limitation of Liability

To the fullest extent permitted by applicable law, Brickstone Works shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, any BW Property. This includes but is not limited to loss of data, loss of progress in any game or application, or any other loss or damage.

In no event shall the total aggregate liability of Brickstone Works to you for any claim arising out of or in connection with these Terms or any BW Property exceed the amount you have paid to Brickstone Works in the twelve (12) months preceding the claim, or £1.00 GBP, whichever is greater.

5. Third-Party Links & Services

BW Properties may contain links to or integrations with third-party platforms and services, including but not limited to itch.io. Brickstone Works is not responsible for the content, privacy policies, security practices, or terms of service of any third-party platform. Your use of any third-party service is governed solely by that service’s own terms.

6. Modifications to These Terms

Brickstone Works reserves the right to update or modify these Terms at any time. The “Last Updated” date at the top of this page will reflect any changes. Your continued use of any BW Property following the posting of revised Terms constitutes your acceptance of those changes. It is your responsibility to review these Terms periodically.

7. Termination

Brickstone Works reserves the right, at its sole discretion, to restrict or revoke your access to any BW Property at any time and for any reason, including but not limited to violation of these Terms, without prior notice or liability.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
